We at Dash Labs, Inc. (“Dash Labs”, “we”, “us”) know you care about how your personal information is used and shared, and we take your privacy seriously. Please read the following to learn more about our Privacy Policy. By using or accessing the Dash Labs website (“Site”), mobile application (“App”) or other Dash Labs product or service (e.g. a device that connects to a vehicle’s OBD II part) (“Device”, collectively with the Site and the App, the “Services”) in any manner, you acknowledge that you accept the practices and policies outlined in this Privacy Policy, and you hereby consent that we will collect, use, and share your information in the following ways.

What does this Privacy Policy cover?

This Privacy Policy covers our treatment of personally identifiable information ("Personal Information") that we gather when you are accessing or using our Services, but not to the practices of companies we don’t own or control, or people that we don’t manage. We gather various types of Personal Information from our users, as explained in more detail below, and we use this Personal Information internally in connection with our Services, including to personalize, provide, and improve our services, to allow you to set up a user account and profile, to contact you, to fulfill your requests for certain products and services, and to analyze how you use the Services. In certain cases, we may also share some Personal Information with third parties, but only as described below.

We do not knowingly collect or solicit personal information from anyone under the age of 13. If you are under 13, please do not attempt to register for the Services or send any personal information about yourself to us. If we learn that we have collected personal information from a child under age 13, we will delete that information as quickly as possible. Will Dash ever change this Privacy Policy?

We’re constantly trying to improve our Services, so we may need to change this Privacy Policy from time to time as well, but we will alert you to changes by publishing a notice through the App or on your profile page, by sending you an email, and/or by some other reasonable means. Please note that if you’ve opted not to receive legal notice emails from us (or you haven’t provided us with your email address), those legal notices will still govern your use of the Services, and you are still responsible for reading and understanding them. If you use the Services after any changes to the Privacy Policy have been posted, that means you agree to all of the changes.

What information does Dash Labs Collect?

Information You Provide to Us:

We receive and store any information you knowingly provide to us. For example, through the registration process and/or through your account settings, we may collect Personal Information such as your name, email address, gender, location, vehicle information, and third-party account credentials (for example, your log-in credentials for Facebook or other third party sites). If you provide your third-party account (“Third Party Account”) credentials to us or otherwise sign in to the Services through a third party site or service, you understand some content and/or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy. This may include your name, gender, location, profile photo, and a list of your “friends” that are also registered members of the Services. Certain information may be required to register with us or to take advantage of some of our features. Note that we don’t actually store your passwords for those Third Party Accounts. Instead, we just use an authentication token to verify your user name.

We may communicate with you if you’ve provided us the means to do so. For example, if you’ve given us your email address, we may email you about your use of the Services. If you do not want to receive communications from us, please indicate your preference by unsubscribing from such messages through the link at the bottom of such emails. If you download the App on a mobile device, we may also send you alerts if your settings on your mobile device permit such alerts. If you do not wish to receive alerts from us, please adjust your settings on your mobile device.

Information Collected Automatically

Whenever you interact with our Services, we automatically receive and record information on our server logs from your mobile device, which may include your device identification and information about the device you’re using to access our Services, and the feature you requested. If you are using our Device in your vehicle, we may also automatically receive and record information from the Device to the extent that your vehicle supports the provision of such information. Such automatically provided information may include the year, make and model of your vehicle, the VIN number of your vehicle, engine light status, throttle position, fuel level, engine coolant temp, engine load, fuel type, oxygen sensor state, diagnostic trouble codes, your current speed, and other variables required in order to provide the Services to you. Additionally, if you use the Device in connection with the App and have enabled location services on your mobile device, we may receive and record your geographic location in order to provide the Services to you. Our collection of your device location information is solely at your discretion. You can enable or disable location services when you use the App at any time, through your mobile device settings. Should you use the Services with location services enabled, you consent to collection and dissemination of your device location information through the Services, as specified in this Privacy Policy.

When we collect the usage information described above, we only use this data to provide the Services to you or in aggregate form, and not in a manner that would identify you personally.

Will Dash Labs Share Any of the Personal Information it Receives?

We neither rent nor sell your Personal Information in personally identifiable form to anyone. However, we may share your Personal Information with third parties as described in this section:

Aggregated Personal Information that’s no longer personally identifiable. We may anonymize your Personal Information so that you are not individually identified, and provide that information to our partners or other third parties. We may also provide aggregate usage information to our partners, who may use such information to understand how often and in what ways people use our Services and to analyze information concerning vehicles or classes of vehicles. However, we never disclose aggregate information to a partner in a manner that would identify you personally, as an individual.

User Profiles and Submissions: Certain user profile information, including your name, photograph, vehicle make, DASH score, average miles per gallon, and total miles driven, may be displayed to other users that are part of your “leaderboard” on the Services. Your account privacy settings allow you to limit the Personal Information in your user profile that may be visible to others. Through your settings you may also choose whether to share additional information with your leaderboard, such as a history of trips you have taken. Additionally, if you sign into the Services through a third party social networking site or service, your list of “friends” from that site or service may be automatically imported to your leaderboard on the Services, and such “friends,” if they are also registered users of the Services, may be able to access certain information you have entered in your Services user profile. Again, we do not control the policies and practices of any other third party site or service.

Business Transfers: We may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. Also, if we (or our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information could be one of the assets transferred to or acquired by a third party.

Protection of Dash Labs and Others: We reserve the right to access, read, preserve, and disclose any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our Terms of Use and other agreements; or protect the rights, property, or safety of Dash Labs, our employees, our users, or others.

Is Personal Information About Me:Your account is protected by a password for your privacy and security. If you access your account via a third party site or service, you may have additional or different sign-on protections via that third party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password and/or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.

We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but unfortunately, we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

What Personal Information Can I Access?

Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

  • Name & Password
  • Email Address
  • Location
  • Vehicle Information

The information you can view, update, and delete may change as the Services change. If you have any questions about viewing or updating information we have on file about you, please contact us at contact@dash.by.

Under California Civil Code Sections 1798.83-1798.84, California residents are entitled to ask us for a notice identifying the categories of Personal Information which we share with our affiliates and/or third parties for marketing purposes, and providing contact information for such affiliates and/or third parties. What Choice Do I Have?

You can always opt not to disclose information to us, but keep in mind some information may be needed to register with us or to take advantage of some of our special features.

You may be able to add, update, or delete information as explained above. When you update information, however, we may maintain a copy of the unrevised information in our records. You may request deletion of your account by logging into your account via the Site. Some information may remain in our records after your deletion of such information from your account. We may use any aggregated data derived from or incorporating your Personal Information after you update or delete it, but not in a manner that would identify you personally.

This privacy notice has a special focus on how our policies relate to the EU’s General Data Protection Regulation.

Who we are

Types of information we collect

The Dash app collects information on your driving behavior in order to build a quantified driving history. Almost all data collection happens while you are driving, so we can create trip logs and tally up mileage totals and fuel efficiency averages.

Here are the most significant pieces of information required in order to provide the product functionality on offer:

  • Name and email address
  • Logs of your driving including GPS location, speeds and vehicle sensor readings
  • Information about your car, including the VIN

How your personal information is used

We use the information we collect to log your driving and create trends summaries. We are also actively using the data to develop new features intended to give you new insights on driving.

We also use anonymized data for business purposes – in particular, we may sell anonymized low-level sensor readings to automotive manufacturers or suppliers. Generally, they use this for their internal technical research or product development, or integrate it with marketing messages. This revenue allows us to offer the app without charge for users.

Legal basis for data processing

Holding and processing the data is integral to the service provided by the app – without it, we could not create trip logs or summaries.

The legal basis for our data processing primarily fits the GDPR definitions of “consent,” as well as “legitimate interest” and “public task.” Primarily, we consider use of the app – particularly connecting to your car in order to log trips – to be an act of consent. “Legitimate interest” comes into play when we share data with third parties who may be of interest to users, and “public task” is the legal basis for sharing data with urban planning commissions.

Sharing of personal data

We never share personally-identifiable information (PII), like names or emails, with third parties without explicit consent. However, we may share anonymized data with business partners; in particular, low-level sensor data as well as speed / location pairs are of interest to automotive suppliers and city planners.

Location of data storage and processing centers

At the time of this writing, all of our core data processing happens in the United States, although we also maintain an EU database for regulatory purposes and partner requirements.

Data security

We work to safeguard data from breaches using current industry-standard security approaches. We have built a robust architecture intended to prevent unauthorized access, including appropriate access control as well as mitigation strategies for DDoS attacks and penetration attempts. Most importantly, we use encryption wherever appropriate, especially the data transfer from our app in the field to our server architecture.

Duration of data storage

Since one of the primary purposes of the Dash is to create a permanent history of your driving, we do not delete information by default. If you wish for your data to be deleted please contact us via email at gdpr@dash.by

Your rights in relation to personal data

We respect all the data rights of our users. Access, download, and portability are achieved directly via the app’s download functionality. You can download your data within the app, by going to the side menu (Android) or under your user profile (iOS). If you would like your data permanently deleted, please contact us via email at gdpr@dash.by

Third Party Content

We may link to other services, websites, or apps within Dash. While we make a good-faith effort to vet these links, you will have a direct relationship with that party and our terms are not applicable to your relationship with these parties.
